Defendant asks to be sent to prison, “if guilty”

Jonathan Charles Folger, 32, of Toulon, appeared in Stark County Circuit Court on Wednesday, June 27th in a special court day setting. Folger told Circuit Judge Steven A. Kouri, “If I was found guilty of these charges, then send me away.”

Folger has been charged with two felony counts of domestic battery against his seven-year-old autistic son, when he allegedly strangled his son. This occurred in the area of the Stark County jail.

Folger has also been charged with resisting arrest. A Class 2 felony. Folger was on felony bond release from Henry County when he allegedly committed the Stark County felonies. Henry County is rethinking a probation sentence there, and pressing for a stiffer sentence in that case. It involves felony driving on a revoked or suspended license.

“They [Henry County officials] are going to make assumptions on these [Stark County] assumptions,” Folger also told Kouri.

A bench trial for Folger has been set for July 6th at 11 a.m. for the Stark County charges. Folger remains in custody at the Stark County jail under a $50,000 bond. Folger is represented by public defender Patrick Murphy.
